Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the ImSpace application ("the App") or visiting the website imspaceapp.com ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

ImSpace is a mobile application for iOS that enables users to:

• Upload photos and transform them into stylized images using various creative styles
• Adjust creativity levels to control the degree of transformation
• Download and share generated images
• Purchase credits through subscriptions or one-time credit packs

The Service is operated by VoiceBeam GmbH.

3. Eligibility

You must be at least 16 years old to use ImSpace. By using the Service, you represent that you meet this age requirement. If you are under 18, you should have your parent or guardian's permission to use the Service.

4. Account Registration

To use ImSpace, you must create an account using Sign in with Apple. You are responsible for:

• Maintaining the security of your Apple ID
• All activity that occurs under your account
• Any content you upload to the Service

5. Acceptable Use

You agree to use ImSpace only for its intended purpose and not to:

• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Upload content that infringes on the intellectual property rights of others
• Use the Service to generate content that is deceptive, fraudulent, or misleading
• Attempt to reverse-engineer, modify, or interfere with the Service
• Use automated tools or bots to interact with the Service

6. Content Ownership and Usage Rights

Your content

You retain ownership of the photos you upload to ImSpace. By using the Service, you grant us a limited, non-exclusive license to process your uploaded photos solely for the purpose of generating stylized images. This license terminates when you delete your account.

Generated images (Output)

You own your Output to the extent permitted by applicable law. You may use your Output for personal or commercial purposes, subject to the following conditions:

• You are responsible for ensuring that your use of Output does not infringe the rights of third parties (including trademarks, publicity rights, and copyright).
• ImSpace does not grant you exclusive rights to any Output. Other users may generate similar or identical images.
• We do not guarantee that Output is unique or non-infringing.

Our intellectual property

The ImSpace app, website, logo, brand, and all related content are the property of VoiceBeam GmbH. The styles, algorithms, and processing methods used by ImSpace are proprietary. We do not claim ownership of your uploaded photos or your generated Output.

7. Credits and Pricing

ImSpace uses a credit-based system for image generation:

• Subscriptions provide monthly credits (Go, Pro, Max tiers). Subscription credits roll over to the next month but expire after two months if unused. New credits are added at the start of each billing cycle.
• Credit packs are one-time purchases. Credits from packs must be used within six months of purchase.
• Each image generation costs a specific number of credits, always displayed before creation.
• All purchases are processed through the Apple App Store.

We reserve the right to modify credit costs and pricing with reasonable advance notice. Existing subscriptions will not be affected mid-cycle.

8. What Happens to Credits on Cancellation

If you cancel your subscription:

• You retain access to your subscription tier until the end of your current billing period.
• Unused subscription credits expire at the end of your billing period (or after two months, whichever is sooner).
• Credits purchased through one-time credit packs remain available for six months from the date of purchase, regardless of subscription status.

9. Refunds

All purchases are made through the Apple App Store and are subject to Apple's refund policy. Credits that have been used cannot be refunded. If you experience technical issues preventing you from using purchased credits, please contact us at info@voicebeam.de.

10. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which explains what data we collect, how we handle it, and your rights under GDPR.

11. Service Availability

We strive to keep ImSpace available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance
• Server issues or third-party service outages
• Factors beyond our control

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

12. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, or error-free
• Generated images will meet your expectations in every case
• Output will be unique, exclusive, or non-infringing
• Any defects in the Service will be corrected

13. Limitation of Liability

To the maximum extent permitted by applicable law, VoiceBeam GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability for any claim arising from the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

14. Account Termination

You may stop using ImSpace and delete your account at any time from within the App. Upon deletion, all your data is permanently removed from our servers (except data we are legally required to retain; see our Privacy Policy). We may suspend or terminate your account if you violate these Terms, with or without prior notice.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Germany.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. If we make material changes, we will make reasonable efforts to notify you. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
